HIPAA Compliance
One of the main purposes of The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is to protect the privacy of personal medical and health information. Section 164.512(e) of HIPAA, Disclosures for Judicial and Administrative Proceedings, states that entities covered under the act are permitted to disclose protected health information in response to a subpoena or other lawful process. In some cases, it may be necessary to obtain authorization in addition to a subpoena when there are sensitive materials or if the deponent is out of state.
